According to the latest updates, the Maharashtra Food and Drug Administration (FDA) has registered a case against Avenue Supermarts, which runs DMart, and five individuals over expired and damaged food at its Bhiwandi warehouses. The Free Press Journal reported on 31 October that the FDA seized expired, spoiled and packaging damaged food worth ₹28,504, including several brands of edible oil, from the company’s distribution centre near Mankoli Naka. The alleged offences relate to the Mankoli Naka and Anjurgaon warehouses between 28 and 29 October. Narpoli police registered the case on a complaint by Kasturi Chiplunkar, FDA Joint Commissioner for the Konkan division, under the Bharatiya Nyaya Sanhita (BNS) and section 59(1) of the Food Safety and Standards Act, 2006.
This development matters because it extends the FDA’s action on expired food in Bhiwandi from quick commerce and cold storage sites to a large supermarket chain. The FDA alleges the company did not follow disposal guidelines dated 3 November 2025, which require video and photo records in front of witnesses, and alleges collusion to move the goods back into the market. No arrests have been made, and Assistant Police Inspector Mahendra Patil is investigating.
In our expert opinion, the small value of the seizure matters less than the charge, because the FDA is treating disposal records as a criminal matter rather than a clerical one. Retailers that run their own distribution centres lose most, since the case names individual staff, while authorised disposal firms with clear audit trails gain work. Coverage misses that the case rests on one seizure and the company’s response has not been reported, so the facts may change. We predict, with medium confidence, that at least one more national retailer or third party logistics (3PL) operator in Bhiwandi will face an FDA case before 31 December 2026.
This is important for our readers because food warehouses in Bhiwandi now face police cases as well as licence action. This week, check that every disposal of expired stock at your sites has video, photos and witness records. Make sure your staff know who signs off each disposal, since the FDA named individuals in this case.
